Buy to Let/Advice on Tenancies

If you are buying a property with a view to renting it out or if you already own a property and are planning to let it out there are various legal requirements with which you must comply.  The sanctions for failure to comply with certain legislative requirements can be serious ranging from large fines to imprisonment and it is accordingly important to obtain expert advice.  It is also important to ensure that you create a short assured tenancy or a commercial tenancy in order to avoid providing the tenant or tenants with security of tenure.  The law in Scotland is different from England.  Some of the requirements that you have to consider include the following:

- landlord registration in terms of Anti-Social Behaviour (Scotland) Act 2004

- repairing standard letters in terms of Housing (Scotland) Act 2006

- the Gas Safety (Installation and Use) Regulations

- the Electrical Equipment Regulations and the Plug and Sockets Regulations

- the repairing standard in terms of the Housing (Scotland) Act 2006

- HMO legislation
